Regarding the incident at Cam Ranh T/O: Sacombank will continue to appeal
04/07/2024The investigation conclusion clearly states that “the documents related to the total amount of VND 46.9 billion were fully signed by Mrs. Duong, with signatures matching those registered at Sacombank.” The forensic conclusion from the Criminal Technical Department of Khanh Hoa Province Police issued on 7/42024, confirms that the signatures and handwriting on the withdrawal/transfer documents were all made by customer Ho Thi Thuy Duong. The civil lawsuit initiated by Ho Thi Thuy Duong for compensation could create overlaps and conflicts with the ongoing criminal case.
Sacombank has repeatedly filed complaints and provided document evidence requesting the suspension of the civil lawsuit with Mrs. Ho Thi Thuy Duong to the Cam Ranh People's Court, Khanh Hoa Province, pending the resolution of the criminal case, but the matter is still being tried. Therefore, Sacombank will continue to appeal to the appellate court to protect its legitimate rights.
Regarding the embezzlement criminal case at Cam Ranh T/O (Khanh Hoa Branch), since the discovery of the incident in October 2022, Sacombank has proactively reported it to the State Bank of Vietnam – Khanh Hoa Branch and transferred the case to the Investigation Agency – Khanh Hoa Province Police for investigation and prosecution, requesting severe penalties for the violations and ensuring customer rights. For customers whose funds were misappropriated and who had no personal loan relationships or signatures on transaction documents with the accused, Sacombank immediately reimbursed the full amount of damage upon discovery of the issue to ensure their legal rights. For customer Ho Thi Thuy Duong, due to some unusual signs, Sacombank has complied with the investigation agency’s request, transferred the case to clarify the nature of the matter, and committed to fulfilling all obligations after the conclusions of the competent authorities. While waiting for the conclusions from the competent authorities, Sacombank has met with customer Ho Thi Thuy Duong multiple times to find solutions to alleviate difficulties according to the customer’s wishes. Sacombank agreed to temporarily disburse VND 20 billion to support the customer in maintaining business operations and stabilizing living conditions while waiting for the issue to be clarified. In November 2023, the Investigation Agency – Khanh Hoa Province Police issued the case investigation conclusion. It recommended prosecuting the involved defendants and identified that they used various methods to withdraw money from customers' accounts at Sacombank, causing Sacombank to lose over VND 17 billion. Specifically for customer Ho Thi Thuy Duong, the conclusion states that “the documents related to the total amount of VND 46.9 billion were fully signed by customer Dương, with signatures matching those registered at Sacombank.” The forensic conclusion from the Criminal Technical Department of Khánh Hòa Province Police issued on 7/4/2024, confirms that the signatures and handwriting on the withdrawal/transfer documents were all made by customer Ho Thi Thuy Duong. |
